American Airlines (AA, Dallas/Fort Worth) has voluntarily withdrawn a USD500,000 claim against logistics giant Kuehne + Nagel over a damaged Rolls-Royce Trent 800 engine in a civil action at the US District Court of Northern Texas, according to court documents reviewed by ch-aviation.
This comes after the airline, on August 30, demanded a jury trial over allegations of contract breach, negligence, and "es ipsa loquitur" against Kuehne + Nagel. The latter allows a court to infer negligence from the nature of an accident or injury in the absence of direct evidence.
The airline was pursuing legal action after the logistics provider allegedly refused to compensate the airline USD520,246 to repair the Trent 800 engine, esn 51238, which was significantly damaged on September 29, 2023, while being transported back to Tulsa International, Oklahoma, following maintenance at Hong Kong International. Specifically, the engine's overspeed protection unit, power conditioning unit, suitcase vent tube, and electrical harness were damaged in transit. The Trent 800 is used on American's fleet of forty-seven B777-200ERs, according to ch-aviation fleets data.
ch-aviation has reached out to both companies for comment. An American Airlines spokesperson told Business Insider the parties were working to resolve the matter.
